Terms of Service

1. Who we are

Eros is a hosted page platform for creators and the agencies that represent them. The service is operated by Needs legal input: registered legal entity name, registered at Needs legal input: registered address (Needs legal input: company number). In these terms, “Eros”, “we” and “us” mean that entity; “you” means the person or organisation holding an account.

By creating an account, publishing a page, or otherwise using Eros, you accept these terms, the Privacy Policy and the Acceptable Use Policy. If you do not accept them, do not use Eros.

2. You must be 18 or over

Eros is not available to anyone under 18. You must be at least 18 years old to create an account, hold a handle, appear as the creator on a page, or be depicted in media uploaded to Eros. This is a firm condition, not a formality — accounts found to belong to or depict a minor are terminated immediately.

If you are accepting these terms for an organisation, you confirm you are authorised to bind it.

3. Your account

Keep your login details private and your contact email current. You are responsible for everything done through your account, including by staff you invite. Tell us promptly at hello@erostest.online if you believe your account has been accessed by someone else.

We may refuse, suspend or close an account where these terms or the Acceptable Use Policy are broken, where we are required to by law, or where continuing would expose other people to harm.

4. Handles

A handle is the address of your page. Handles are issued first come, first served, except that some are permanently reserved — application routes, our own brand terms, and words we judge to carry a high risk of abuse.

• You may not register handles in bulk, or in order to resell them.
• You may not use a handle to impersonate another person, business or brand.
• We may reclaim a handle that impersonates someone, infringes a trade mark, or is being used to break these terms. Where we can, we will contact you first.
• A handle is a licence to use an address on our service. It is not property and you do not own it.

5. Your content stays yours

You keep every right you already have in the text, images, video and other material you put on Eros. We claim no ownership of it.

So that we can actually run the service, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, resize, cache and publicly display your content — but only for the purpose of operating, securing and promoting the parts of Eros where you have chosen to publish it. That licence ends when you delete the content or close your account, except for copies held in routine backups until they expire, and anything we must retain by law or as evidence in a safety investigation.

6. What you promise about your content

Every time you publish on Eros, you confirm all of the following. These are the promises we rely on, and breaking them is grounds for immediate termination.

• You own the content, or you have permission from whoever does.
• Every identifiable person in it was at least 18 years old when it was made, and gave informed consent to appear in it and to it being published here.
• Consent has not since been withdrawn in a way that would make publication wrongful.
• The content does not infringe anyone's copyright, trade mark, privacy or publicity rights.
• The content complies with the Acceptable Use Policy, including the rule that media hosted on Eros is safe for work.

If you cannot honestly make every one of these promises about a piece of content, do not upload it.

7. Links to other sites, including age-restricted ones

Eros pages exist to send people somewhere. You choose those destinations and you are responsible for them. We do not review, endorse, guarantee or take responsibility for any site you link to, and your relationship with a destination — including anything you sell or are paid for there — is between you and them.

You may link to destinations that are restricted to adults, provided you comply with the Acceptable Use Policy and with the law in the places your audience actually is. In particular:

• The destination must be labelled as age-restricted before anyone taps through.
• You must not disguise where a link goes, use an intermediate page to hide the destination, or open destinations without a deliberate action by the visitor.
• You are responsible for any age-verification obligation that applies to your destination in your audience's jurisdiction. Eros labelling a link does not discharge that obligation.

8. Agency accounts, claim links and parting ways

An agency account may hold pages for many creators, invite staff, and give each member a role that limits what they can see and change. The agency is responsible for what its members do.

Building a page before a creator has an account

An agency can build a page and then send a single-use claim link. The creator accepting that link takes ownership of the page. Until it is claimed, the agency controls the page and must have the creator's permission to represent them.

When a creator and an agency separate

Agree this in writing between yourselves before it happens. Absent a written agreement between the creator and the agency, our default position is:

• A claimed page belongs to the creator who claimed it, and they may remove the agency's access at any time.
• An unclaimed page belongs to the agency that created it.
• A custom domain follows whoever holds the domain registration, not the page.
• Historical page statistics stay attached to the page.
• An agency may keep templates and funnel structures it built, but not the creator's photographs, video, name or likeness.
• Verification status does not transfer. A page that changes hands must be verified again.

9. What verification means

Where a page shows a verified marker, it means one narrow thing: we have taken steps to confirm that the page is run by, or with the authority of, the person it presents.

It does not mean the person or the page is trustworthy, safe, endorsed by us, high quality, accurate, suitable for any particular audience, or approved in any way. Do not present it to your audience as if it did.

We may mark verification as expired, revoked or requiring renewal, including after a page changes hands or where information we relied on turns out to be wrong.

10. Acceptable use

The Acceptable Use Policy forms part of these terms. It sets out what may be hosted on Eros, what may be linked from it, and the conduct that will get an account removed. Read it — it is short, and it is the part we enforce most often.

11. Plans, payment and tax

Eros offers a free tier and paid plans. Paid features are described at the point of purchase, and the price shown there is the price that applies to your subscription until we tell you otherwise.

• Subscriptions renew automatically for the period you selected until cancelled.
• Cancel any time; cancellation takes effect at the end of the period you have paid for.
• Except where the law gives you a refund right, payments already made are not refundable.
• Prices exclude tax unless stated. You are responsible for tax on money you earn through your page.
• If a payment fails we may downgrade or suspend paid features after telling you.

Paid plans are not yet available. Until billing goes live, no charge is made for any part of Eros and the prices shown on our pricing page are indicative only.

12. Suspending or closing accounts

You can close your account at any time from your dashboard or by emailing us. Closing it unpublishes your pages.

We may unpublish a page, restrict features, or close an account where these terms or the Acceptable Use Policy are broken, where we must act to comply with the law or a valid order, or where leaving something up would put someone at risk. Except where content involves a minor, is non-consensual, or must be removed urgently, we will tell you what happened and how to respond.

We keep records of enforcement action, including removed content where we need it as evidence, for as long as is necessary.

13. Copyright and other complaints

If something on Eros infringes your rights, email hello@erostest.online with enough detail for us to find it: the page address, what the material is, what right you hold, and a statement that you believe the use is unauthorised. We will review it and, where the complaint is well founded, remove or restrict the material.

We may pass your complaint to the account holder, and we may reinstate material if they respond with a valid counter-notice. Repeat infringers lose their accounts.

14. Availability, disclaimers and liability

We work to keep Eros running but we do not promise it will be uninterrupted or error-free, and we may change or withdraw features. Except where the law says otherwise, Eros is provided as is, without warranties of any kind.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. Subject to that, we are not liable for lost profits, lost revenue, lost data or indirect loss, and our total liability to you in any twelve-month period is limited to the greater of the amount you paid us in that period and Needs legal input: cap figure and currency.

You agree to cover our reasonable losses if a third party brings a claim against us because of content you published or a destination you linked to.

15. Changes

We may update these terms. Where a change materially reduces your rights we will give reasonable notice — at least Needs legal input: notice period — by email or in the product before it takes effect. Continuing to use Eros after that means you accept the new version.

16. Governing law

These terms are governed by the law of Needs legal input: governing jurisdiction, and the courts of Needs legal input: jurisdiction have exclusive jurisdiction over any dispute. Nothing here removes any right you have to bring a claim in your own country of residence where the law gives you that right.
